After the conclusion of the trial and the confirmation of the conviction on appeal, the reasons for the verdict in the case of the nautical homicide of Greta Nedrotti and Umberto Garzarella have been published. The two German tourists, Patrick Kassen and Christian Teismann, have been found guilty of running over and killing the young people on a motorboat in the Gulf of Salò on the evening of June 19, 2021. The judges had already confirmed the sentences of 4 years and 6 months for Patrick Kassen and 2 years and 11 months for Christian Teismann.
According to the judges, even assuming that Teismann was asleep during the navigation and considering that he was not a co-driver but only a passenger, the fact that the defendant entrusted the driving of the motorboat to Kassen, who was clearly drunk, in order to avoid any responsibility, is a decisive circumstance. Furthermore, it is highlighted that Teismann had put into navigation a boat without the technically suitable lights for night navigation.
The reasons for the verdict also emphasize that the occupants of the motorboat were unable to see the navigation lights of the German tourists’ boat due to the side lights or even because they were not visible due to the high speed of the motorboat, which was four times higher than the limits allowed by law.
